3. DATA BACKUP AND DATA LOSS (CUSTOMER RESPONSIBILITY) Your use of the Services is at your sole risk. Hostiso does not maintain comprehensive or continuous backups of Customer Content. While Hostiso may perform routine backups for its own disaster recovery purposes, these backups are not guaranteed to be available to you, and Hostiso is not obligated to restore your data.
You agree to bear full responsibility for backing up all of your Customer Content, including websites, databases, and emails, to a third-party location independent of Hostiso’s infrastructure. In the event of data loss, corruption, hardware failure, or security breach, Hostiso shall have absolutely no liability for any lost, damaged, or unrecoverable Customer Content. Under no circumstances will Hostiso be held responsible for damages resulting from data loss.
4. ZERO TOLERANCE FOR ILLEGAL CONTENT AND CHILD EXPLOITATION Hostiso strictly prohibits the hosting, transmission, or storage of any illegal content. Child Sexual Abuse Material (CSAM): We maintain a strict zero-tolerance policy regarding the viewing, storage, distribution, or promotion of child exploitation material. If Hostiso discovers, or is notified of, any Customer Content containing CSAM or images of minors used in an illegal or exploitative manner, we will take the following immediate actions:
Instant Termination: Your Account and all associated Services will be terminated immediately, without prior notice and without any possibility of a refund.
Data Preservation & Reporting: We will immediately preserve the related data and report the incident, along with the Customer's identifying information (IP address, billing details, logs), to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies in the United States and internationally.
Hostiso acts strictly as an infrastructure provider and claims Safe Harbor protections under applicable US laws. We are not responsible for user-generated content, but we will cooperate fully with law enforcement upon the discovery of any illegal activities.
5. ACCEPTABLE USE POLICY (AUP) You agree to use the Services only for lawful purposes. You are strictly prohibited from using the Site or Services to:
Engage in any form of fraud, phishing, or identity theft.
Distribute malware, viruses, Trojan horses, or any malicious code.
Conduct Denial of Service (DDoS) attacks, network scanning, or unauthorized server penetration.
Operate unsolicited bulk email (SPAM) networks.
Host content that is defamatory, harassing, promotes terrorism, or violates the intellectual property rights of any third party.
Hostiso reserves the right (but undertakes no duty) to monitor Customer Content and suspend or terminate Accounts found violating this AUP, at our sole discretion.
6. DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) POLICY Hostiso respects the intellectual property rights of others. In accordance with the DMCA, we will respond expeditiously to valid notices of copyright infringement. If we receive a valid DMCA takedown notice, we reserve the right to disable access to the infringing material. Repeat infringers will have their Accounts permanently terminated.
7. SERVICE LEVEL AGREEMENT (SLA) AND UPTIME Hostiso strives to provide high availability for all Services. However, you acknowledge and agree that from time to time the Services may be inaccessible or inoperable for any reason, including but not limited to: periodic maintenance, network congestion, equipment failures, or events beyond our reasonable control (Force Majeure). Hostiso makes no absolute guarantees regarding continuous, uninterrupted uptime, and shall not be held liable for any business interruptions or lost revenue resulting from downtime.
8. FEES, PAYMENTS, AND AUTO-RENEWAL
Subscription Basis: All paid Services are provided on a subscription basis. By adding a Payment Method, you authorize Hostiso to charge you automatically for Service renewals until you explicitly cancel your subscription via your Account dashboard.
Taxes: All fees are exclusive of applicable taxes. You are responsible for all taxes levied on the Services based on your billing jurisdiction.
Refund Policy: All fees are non-refundable unless expressly specified otherwise in a separate Refund Policy. Hostiso reserves the right to suspend or terminate Services immediately in the event of a chargeback or payment dispute.
9. DISCLAIMER OF REPRESENTATIONS AND WARRANTIES The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Hostiso, its officers, directors, employees, and agents explicitly disclaim all statutory, express, or implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will meet your specific requirements, be free of errors, or be completely secure.
10. LIMITATION OF LIABILITY To the maximum extent permitted by applicable law, in no event shall Hostiso, Aveliso LLC, or its affiliates be liable to you or any third party for any indirect, consequential, incidental, punitive, or special damages, including but not limited to loss of profits, loss of data, loss of business, or unauthorized access to your servers. In no event shall Hostiso’s total aggregate liability arising out of or related to this Agreement exceed the actual amount of fees paid by you for the specific Service in the three (3) months immediately preceding the event giving rise to the claim.
11. INDEMNIFICATION You agree to protect, defend, indemnify, and hold harmless Hostiso, Aveliso LLC, and its officers, directors, and employees from and against any and all claims, demands, costs, expenses (including reasonable attorneys’ fees), losses, or damages arising out of: (i) your use of the Services; (ii) any Customer Content hosted on your Account; (iii) your violation of any third-party right (including copyright, trademark, or privacy rights); (iv) your violation of any provision of this Agreement.
12. GOVERNING LAW AND DISPUTE RESOLUTION
Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of laws principles.
Jurisdiction: Any legal action or proceeding relating to your access to or use of the Services shall be instituted exclusively in a state or federal court located in Wyoming. You and Hostiso agree to submit to the jurisdiction of, and agree that venue is proper in, these courts.
13. GENERAL PROVISIONS
Right to Refuse Service: Hostiso reserves the right to refuse Service to anyone, at any time, for any reason, in our sole discretion.
Severability: If any provision of this Agreement is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will remain in full force and effect.
Modifications: Hostiso reserves the right to modify these Terms of Service at any time. Your continued use of the Services following any posted changes constitutes your acceptance of such modifications.

Abuse of Refund Policy: The purpose of the refund is for customers to see if the services provided by Hostiso suit their needs. Hostiso will not tolerate abusive usage of refunds (i.e., refunding the same services multiple times or repetitively purchasing and asking for a refund). Hostiso reserves the right to unilaterally decline the request for a refund if any signs of abuse occur.

New Domain Name Registrations: Refundable only if at the moment of initiation of the refund, both of the following conditions are met: (i) the domain name refund is initiated within 96 hours from the registration, and (ii) more than 24 hours have passed from the moment of initiation of the last refund of any other domain name registration for your account.

Domain Name Transfers: Refundable only if the domain name transfer is unsuccessful and the refund is initiated within 30 days from payment for such a transfer.
REFUNDS FOR SPECIAL DEALS From time to time, Hostiso may offer special deals, such as a free domain when buying an annual hosting plan. Free domains provided as part of special deals are non-refundable. If you request a refund for a hosting plan that included a free domain, Hostiso will deduct the standard, regular price of the domain name from the refunded amount. You will retain ownership of the domain name for the remainder of its registration period.
REFUNDS TO ACCOUNT BALANCE We provide refunds to the original funding source. However, if you would like to use funds to purchase another Hostiso service instantly, you can select a refund to your Hostiso Account Credit/Balance. Please note that once a refund to the Account Balance is initiated, it becomes irrevocable and cannot be transferred back to a credit card or bank account.
CHARGEBACKS AND PAYMENT DISPUTES If at any time, we record a decline, chargeback, reversal, payment dispute, or risk of payment fraud related to your Hostiso account (“Chargeback”), this will be considered a severe breach of your payment obligations.
In the event a Chargeback is performed:
Your Hostiso account and all associated Services (including websites, VPS, and domains) will be immediately suspended or terminated without prior notice.
All data contained in such an account may be permanently destroyed.
The option to checkout with a credit card for your account will be permanently disabled to limit the risk of fraud.
Cases related to criminal fraud chargebacks or obvious payment fraud (i.e., using compromised credit cards) will result in permanent service termination without any option to recover data, and the information may be reported to relevant authorities.
If you have any questions or concerns regarding a payment made to Hostiso, we strictly encourage you to contact our Customer Support team to resolve the issue before filing a Chargeback with your bank. Filing an unwarranted Chargeback may result in you being liable for dispute fees and administrative costs.

2. ILLEGAL ACTIVITIES AND CONTENT Users may not use the Services to engage in any activity that violates applicable local, state, national, or international laws. Strictly prohibited content and activities include, but are not limited to:
Hosting, distributing, or linking to pirated software, cracked media, or stolen credentials.
Engaging in identity theft, phishing, or financial fraud.
Promoting violence, terrorism, or hate speech against any group.
Selling or distributing prescription medication without a valid license, illegal drugs, or illegal weaponry.
3. ZERO TOLERANCE FOR CHILD EXPLOITATION (CSAM) Hostiso maintains a strict zero-tolerance policy regarding the hosting, distribution, or promotion of Child Sexual Abuse Material (CSAM). Any User found to be hosting such content will have their account terminated immediately without notice and without a refund. In compliance with US law, Hostiso will preserve the data and report the User’s identifying information, IP logs, and content to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement agencies.
4. SYSTEM AND NETWORK SECURITY ABUSE You are strictly prohibited from utilizing our servers or networks to compromise the security of other servers, networks, or websites. Prohibited activities include:
DDoS Attacks: Initiating or participating in Distributed Denial of Service (DDoS) attacks.
Hacking & Scanning: Unauthorized access to or use of data, systems, or networks, including port scanning, vulnerability probing, or packet spoofing.
Malware & Viruses: Hosting, distributing, or executing malicious code, ransomware, Trojans, or viruses.
Cryptocurrency Mining: The use of Hostiso’s shared hosting or VPS resources for mining cryptocurrencies (e.g., Bitcoin, Monero) is strictly prohibited. Any server found running mining scripts will be immediately terminated.
5. EMAIL AND ANTI-SPAM POLICY Hostiso strictly prohibits the sending of unsolicited bulk email (SPAM).
You may not use our Services to send SPAM, operate open mail relays, or send emails to purchased/scraped lists.
All commercial emails sent from our network must fully comply with the CAN-SPAM Act of 2003, including providing a clear opt-out mechanism.
If your activities cause Hostiso’s IP addresses to be blacklisted by anti-spam organizations (e.g., Spamhaus), your account will be suspended, and you may be held financially liable for the costs associated with IP delisting.
6. RESOURCE USAGE (FAIR USE POLICY) To ensure stable performance for all clients, Users on Shared Hosting environments must comply with our fair use limits. You may not:
Use shared hosting accounts as a dedicated backup, file-sharing, or storage repository.
Run continuous background processes, daemons, or excessively demanding scripts (e.g., IRCD, heavy web scrapers) that consume disproportionate CPU, RAM, or Disk I/O resources.
Host tube/video streaming sites or large image-hosting platforms on standard shared environments.
Hostiso reserves the right to temporarily suspend or limit resource-heavy accounts to prevent degradation of service for other Users on the same node.
7. INTELLECTUAL PROPERTY AND COPYRIGHT (DMCA) Users may not use the Services to infringe upon the patents, trademarks, copyrights, or trade secrets of others. Hostiso complies with the Digital Millennium Copyright Act (DMCA). Upon receipt of a valid DMCA takedown notice, we will temporarily or permanently disable access to the infringing content. Repeat copyright infringers will have their accounts permanently terminated.
8. ENFORCEMENT AND CONSEQUENCES OF VIOLATION Hostiso acts strictly as an infrastructure provider and does not actively monitor all Customer Content. However, if we become aware of a violation of this AUP, Hostiso, in its sole and absolute discretion, may take any of the following actions:
Issue a warning to the User.
Temporarily suspend the offending Service or Account.
Remove or disable access to the prohibited content.
Permanently terminate the Account and all associated Services.
No Refunds for AUP Violations: Any Service suspended or terminated due to a violation of this Acceptable Use Policy will not be eligible for a refund, regardless of the remaining time in the billing cycle.

2. 99.9% UPTIME GUARANTEE Hostiso guarantees a 99.9% Network and Server Uptime for all Shared Hosting, Reseller Hosting, and VPS services in any given calendar month. "Uptime" refers to the availability of the server and network infrastructure. It does not include the availability of individual websites, databases, or applications if the underlying server is fully operational.
3. SERVICE CREDITS If Hostiso fails to meet the 99.9% uptime guarantee in a given calendar month, you may be eligible to receive a Service Credit applied to your account balance, which can be used for future Hostiso invoices.
Service Credits are calculated as a percentage of your monthly base hosting fee (excluding any add-ons, software licenses, or domain registrations) as follows:
99.9% - 100% Uptime: No credit
99.0% - 99.8% Uptime: 5% Service Credit
98.0% - 98.9% Uptime: 10% Service Credit
Less than 98.0% Uptime: 25% Service Credit
Maximum Credit: The maximum Service Credit issued in any single calendar month will not exceed 25% of the total monthly fees paid by the Customer for the affected Service. Service Credits are issued as Account Credits only and cannot be refunded as cash to a credit card, PayPal, or bank account.
4. EXCLUSIONS FROM DOWNTIME The uptime guarantee applies strictly to our network and hardware infrastructure. Downtime caused by any of the following events will not be counted against the SLA and will not be eligible for Service Credits:
Scheduled Maintenance: Routine maintenance, hardware upgrades, or software patching announced at least 24 hours in advance.
Emergency Maintenance: Critical, unforeseen maintenance required to patch severe security vulnerabilities or prevent hardware failure.
Customer-Caused Issues: Downtime caused by the Customer’s custom scripts, coding errors, database errors, installation of third-party software, or exceeding allocated resources.
AUP/ToS Violations: Service interruptions caused by Hostiso suspending the account due to violations of our Acceptable Use Policy or Terms of Service (e.g., SPAM, malware hosting, or unpaid invoices).
DDoS Attacks: Outages resulting from Distributed Denial of Service (DDoS) attacks directed at your specific server or website.
Force Majeure: Events beyond Hostiso’s reasonable control, including acts of God, natural disasters, war, major upstream internet backbone outages, or telecommunications failures.
5. SLA CLAIM PROCESS To receive a Service Credit, you must submit a formal request to our billing department by opening a support ticket.
Timeframe: Your claim must be submitted within seven (7) days following the end of the calendar month in which the downtime occurred.
Required Information: Your ticket must include the dates, times, and duration of the downtime, as well as any relevant error logs or monitoring reports.
Hostiso’s internal monitoring systems will be the sole and final authority in determining whether the SLA was breached and whether an outage qualifies for a Service Credit. Data from third-party monitoring services (e.g., UptimeRobot, Pingdom) provided by the Customer will be considered but are not definitive.
